1. Operator and scope
icekem.com and the icekem mobile applications are operated by EXPLIT SOFTWARE COMPANY LIMITED, Vietnam, tax identification number 0317748612. These Terms govern your use of icekem. By accepting them when creating an account or submitting content, you enter into an agreement with the operator. You must be at least 18 years old to use icekem and have legal capacity to enter into this agreement and authority to act for any business or person you represent. The Privacy Policy explains how we process personal data; accepting these Terms does not replace any separate consent required by law.
2. A discovery and discussion platform
icekem helps people find property rentals in Vietnam, send rental requests, contact agents and owners, and ask or answer community questions. Listings and discussions can be updated as users provide new information. References to current or real-time information do not guarantee instant updates, continuing availability or live inventory verification.
We provide the platform, not the property transaction. We are not the landlord, tenant, property broker, guarantor, escrow provider or a party to users' rental agreements, and do not receive deposits or rent on their behalf. Fees for icekem subscriptions or promotion pay for platform features, not for a rental, reservation or guarantee. Users negotiate, verify, contract and pay each other independently.
Check the property's existence and condition, availability, ownership or agent's authority, price, additional charges, contract and payment instructions yourself. Map positions, currency conversions, descriptions, reviews and availability may be inaccurate or outdated. A profile labelled Agent, a subscription badge, a positive review or a promoted listing is not verification, licensing, endorsement or a promise of safety. Information on icekem is not professional legal, financial or property advice.
3. Accounts and your submissions
Provide accurate account information, protect your credentials and promptly report unauthorized access. You are responsible for your lawful use of the service and content you submit. Listings must accurately describe what is offered and be updated or hidden when no longer available. Only offer a property you are authorized to advertise. Reviews must reflect genuine experience; do not impersonate others, fabricate reviews or misuse another person's contact information.
You must hold the copyright, publicity, privacy and other permissions necessary to publish your text, images and video and to grant the licence below. Do not upload confidential documents, bank-card details or sensitive information in public content or messages. Private messaging is not an end-to-end encrypted or guaranteed confidential channel; authorized moderation and support access are explained in the Privacy Policy.
4. Rights in public content
You keep ownership of your content. For material you choose to publish publicly after accepting these Terms, you grant EXPLIT SOFTWARE COMPANY LIMITED a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to store, reproduce, publish, display, distribute, translate, crop, resize, edit and adapt that material to operate, develop and promote icekem. This includes commercial advertising, social media, promotional campaigns and other media formats, without a separate content fee. Transfers and sublicences must serve these purposes, for example to service providers, advertising partners or a successor operating icekem.
This licence covers eligible public listings, photos, videos, profiles, questions, answers and reviews; it does not transfer all copyright or authorize unlawful uses. Private messages, support correspondence, identity documents, credentials and payment information are excluded. You must have the necessary permissions for identifiable people and third-party material. Personal-data use remains subject to the Privacy Policy and applicable law; separate consent must be obtained where required. Publication does not imply that a person endorses icekem or a third-party product.
When you delete content or your account, we stop new promotional use and remove promotional copies under our control within a reasonable time, subject to legally necessary preservation and technical cleanup. Copies independently made by other users, recipients or search engines may remain outside our control. Contact Support to identify material requiring removal. The licence does not override mandatory privacy or deletion rights. We do not claim this version was accepted for older submissions merely because these Terms were updated.
5. Conduct, moderation and complaints
Fraud, unlawful offers, threats, harassment, hate speech, sexual exploitation, unlawful discrimination, privacy or intellectual-property violations, fake reviews, spam, impersonation and interference with the service are prohibited. Do not scrape personal data, bypass access restrictions or security controls, or use the service to harm others.
Use the available report or block controls, or contact Support with the relevant link and details. We may review content and communications, restrict visibility, remove content or suspend accounts for violations, legal requirements or safety reasons. Moderation is not a guarantee that every submission is checked or safe. Where appropriate and legally possible, we explain restrictions and provide an opportunity to challenge them through Support. We may act immediately when necessary to prevent harm. For a copyright complaint, identify the protected work, the allegedly infringing content, your authority and contact details.
6. Plans, purchases and promotion
Optional Lite, Pro and Gold plans and individual UP or Boost purchases provide the benefits, limits, duration and price displayed before checkout. Free-plan allowances may also apply. Store prices, currencies and taxes are those shown in the store purchase confirmation; prices shown elsewhere may differ. Store purchases are processed by Apple or Google and become available after verification against the relevant icekem account.
Subscriptions renew automatically unless cancelled in the relevant store account before renewal. For Apple subscriptions, cancel at least 24 hours before the current period ends to avoid the next renewal charge. The store controls billing and the effective date of a plan change: upgrades normally take effect immediately and downgrades at the next renewal, subject to the store's confirmation. The current plan may therefore remain active until its displayed validity date even after a downgrade is scheduled. Manage or cancel through the app's subscription-management link or your store settings. Deleting the app or icekem account does not cancel the store subscription.
Plan promotion allowances apply to the displayed period; unused included allowances do not accumulate. Switching plans during a period does not erase usage already counted. Separately purchased UP and Boost credits are distinct from included allowances and are used according to the promotion rules shown in the app. UP changes a listing's ordering at the time it is applied; Boost and Super Boost provide temporary prominence. Eligibility, active-promotion restrictions and cooldowns apply, including the displayed ten-minute UP cooldown. Promotion does not guarantee a fixed position, number of views, enquiries or a successful rental.
When an individual UP or Boost is bought from a listing's promotion panel, the app attempts to apply it to that eligible listing after the purchase is confirmed. A cancelled, pending or unverified purchase is not a successful activation. If the store confirms payment but the benefit is missing, use the available restore controls for subscriptions or contact Support with the transaction identifier; do not send card details or purchase repeatedly to resolve the error. Refunds, cancellation rights and remedies for failed services follow applicable law and store rules. No term here removes mandatory refund or consumer rights.
7. External services and software
Maps, external websites, WhatsApp and other third-party services have their own terms and privacy policies. We do not control their availability or the transactions you make through them. Our platform software, branding and other original materials remain protected; the permission to use the service does not grant ownership of them. For an app obtained from Apple, Apple's applicable standard or separately provided end-user licence governs the software licence; these Terms govern the icekem service and do not override mandatory store terms.
8. Availability and limits of responsibility
To the maximum extent permitted by applicable law, icekem is provided as is and as available. We do not warrant uninterrupted or error-free operation, the accuracy, legality or safety of user content, property quality or availability, or the conduct or performance of other users. You evaluate offers and enter into transactions at your own discretion and risk.
To the extent legally permitted, we are not liable for losses caused by independent dealings between users or for indirect or consequential losses, including lost profit, missed rental opportunities or business interruption. Where a contractual cap is lawful, our aggregate liability for the icekem service is limited to the greater of USD 50 or the amount you paid for icekem services in the 12 months before the event giving rise to the claim, including payments through app stores. This cap does not restrict a mandatory refund or other remedy.
Nothing in these Terms excludes responsibility that cannot legally be excluded, including fraud, wilful misconduct, applicable liability for personal injury, mandatory consumer protections or our own data-protection obligations. Our role as a platform does not exempt us from legal obligations relating to the platform, moderation or paid services. These limits apply only as far as the law allows.
9. Ending use, changes and applicable law
You can stop using icekem and permanently delete your shared website and app account in Settings → Delete account → Delete permanently, or request deletion through Support. Permanent deletion cannot be undone. Freezing is a separate reversible option and does not delete your data. Deleting a question also removes replies beneath it; deleting the account removes associated conversations from our database, including the other participant’s messages. The Privacy Policy explains data and media cleanup. Subscription cancellation is handled separately by the store. Termination does not remove obligations already lawfully incurred or statutory remedies.
We may update the service and these Terms. Material changes will be communicated through the service or an appropriate contact channel, with advance notice where required. Additional agreement or consent will be obtained where necessary; a change does not retroactively authorize new uses of personal data. Applicable mandatory rights continue to apply.
These Terms are governed by the laws of Vietnam, without depriving consumers of mandatory protections or access to competent courts and authorities available under applicable law. Contact us first if you want help resolving a complaint; this is not a requirement to waive legal remedies or accept compulsory arbitration. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
